This legislation mandates that the Small Business Administration (SBA) require specific citizenship status documentation from applicants for loans under Section 7(a) of the Small Business Act and Title V of the Small Business Investment Act of 1958. All applicants, whether individuals or business concerns, must provide their date of birth and certify their citizenship status. Individual applicants must be U.S. citizens, nationals, or lawful permanent residents , and for business concerns, 100 percent of their beneficial ownership must be held by individuals with these statuses. Lawful permanent residents are also required to provide their alien registration number as part of the application. The bill establishes that applicants are ineligible if they fail to provide the required information or if any direct or indirect owner of an applicant concern is an "ineligible person." This category broadly includes asylees, refugees, nonimmigrant visa holders, Deferred Action for Childhood Arrivals (DACA) recipients, and individuals without lawful immigration status in the United States.
