This legislation amends Title XI of the Social Security Act to restrict healthcare providers participating in Medicare and State health care programs , including Medicaid and CHIP, from collecting specific personal information from minors. Specifically, it prohibits these providers from requesting information related to a minor's gender identity or sexual preference through intake forms or any other data collection process. The prohibition is not absolute; such information may only be requested if it is determined to be essential for the diagnosis, treatment, or prevention of a condition for which the minor is seeking care, based on applicable clinical guidelines or medical necessity criteria. Furthermore, the bill mandates that the Secretary of Health and Human Services establish a mechanism within 180 days of enactment, allowing individuals to report instances where this prohibited information is requested from minors.
