The Small and Homestead Independent Producers Act of 2025 seeks to enable small cultivators of cannabis and small manufacturers of cannabis products to ship their goods using the United States Postal Service or private interstate carriers. This authority is granted to businesses located in states where such activities are lawful, allowing them to ship to individuals in the same or other states where possession is legal for the recipient. The bill precisely defines "small" based on cultivation canopy size for cultivators or gross annual revenue under $5 million for manufacturers. To ensure responsible delivery, the legislation requires all carriers to verify that recipients are at least 21 years old, utilizing reliable online services or government-issued identification. While the Act generally preempts state laws that restrict direct interstate or intrastate shipment of cannabis where possession is otherwise lawful, it explicitly does not preempt state laws prohibiting cannabis entirely, except for allowing its transport through such states to a legal destination. Additionally, the bill amends federal law to specifically authorize the Postal Service to transmit cannabis in the mail, subject to its own regulations. Importantly, all provisions of this Act are contingent upon the federal descheduling of cannabis from the Controlled Substances Act and the elimination of all federal criminal penalties related to its manufacture, distribution, or possession.
