The Algorithmic Transparency and Choice Act mandates that online platforms implement specific requirements for minors concerning personalized recommendation systems. One year after enactment, platforms must provide minors with a clear notice when they first interact with a personalized recommendation system, informing them of its use. Platforms are also required to offer minors the ability to easily switch between a personalized recommendation system and an input-transparent algorithm , which does not use user-specific data unless expressly provided for that purpose. Minors must also have the option to limit the types or categories of recommendations they receive. Crucially, an input-transparent algorithm must be the default setting for minors on these platforms. The Federal Trade Commission (FTC) is tasked with enforcing these provisions, treating violations as unfair or deceptive acts or practices. However, the bill clarifies that platforms are not required to disclose trade secrets, confidential business information, or privileged information. Furthermore, the Act preempts any conflicting state or local laws covering these specific requirements.
