This bill, titled the "Household Goods Shipping Consumer Protection Act," aims to enhance consumer protection within the household goods shipping industry. It grants the Secretary of Transportation, through the Federal Motor Carrier Safety Administration, direct authority to administratively assess civil penalties against persons who violate commercial regulations related to household goods transportation. This provision strengthens federal oversight and enforcement capabilities against non-compliant carriers and brokers. The legislation also empowers states by allowing them to utilize federal Motor Carrier Safety Assistance Program (MCSAP) grant funds for the enforcement of both federal and compatible intrastate household goods statutes and regulations. Importantly, states are given the discretion to participate in these enforcement activities, and such participation is not a condition for receiving grant funds. Furthermore, the bill permits states to retain any fines or penalties they impose on carriers or brokers for violations, providing a financial incentive for robust state-level enforcement. To improve transparency and accountability, the bill establishes new registration requirements for motor carriers, freight forwarders, and brokers. These entities must now designate a principal place of business , defined as a physical location where management operates, significant business is conducted, and records are maintained. Additionally, freight forwarders and brokers are required to disclose any common ownership, management, control, or familial relationships with other transportation entities that occurred within the preceding three years. Failure to designate a valid principal place of business can lead to the withholding, suspension, amendment, or revocation of an entity's registration by the Secretary.
