The "DOCTORS Act" proposes to amend the Immigration and Nationality Act to establish a system for reallocating unused waivers of the foreign residency requirement for certain J-visa holders. Beginning in fiscal year 2026, state agencies are required to report annually to the Secretary of State the number of waivers they did not utilize, ensuring that available waivers are not wasted. The Secretary of State will then calculate the total number of unused waivers and redistribute a portion of them as "supplemental waivers" to eligible state agencies for the subsequent fiscal year. To be considered an eligible State agency , an agency must have used at least 30 waivers in the preceding fiscal year. Furthermore, 10 percent of these reallocated supplemental waivers must be used to support positions in facilities serving patients in medically underserved communities .
