The "Learning Innovation and Family Empowerment with AI Act," or the "LIFE with AI Act," seeks to modernize student data privacy protections, empower parents, and foster innovation in personalized learning, particularly through artificial intelligence. It introduces several key provisions to achieve these goals, primarily by amending the Family Educational Rights and Privacy Act (FERPA). A central feature is the establishment of a "Golden Seal of Excellence in Student Data Privacy" for elementary and secondary schools and local educational agencies. To qualify, recipients must implement instant verification technology for parental consent regarding educational technology use, provide detailed information on data practices, and offer accessible opt-out mechanisms. This seal signifies adherence to high standards of student data privacy and proactive parental engagement. The bill significantly updates FERPA by simplifying the process for parents to opt-out of the release of directory information , requiring clear online notices and easy-to-complete, year-round digital forms. It also prohibits the use of student photographs for training facial recognition systems without prior parental consent and restricts schools from doing business with yearbook companies that use facial recognition without disclosure and consent, or that sell student data. Furthermore, the legislation broadens the definition of "education records" under FERPA to include any data or materials related to a student, such as academic performance, attendance, health, and discipline, maintained by an educational agency or institution. It also imposes new requirements for contracts with third-party educational technology providers, mandating public availability of these contracts, third-party certification of privacy compliance, and a mechanism for reporting and investigating non-compliance, with a public list of violators. To support these changes, the bill directs the Secretary of Education to create a Privacy Technical Assistance Center to help educational entities understand and meet federal privacy laws. This center will also establish a safe harbor program for educational technology providers who meet stringent privacy and security standards. Finally, the Act promotes the responsible integration of AI in K-12 classrooms by developing training resources for teachers and prioritizing educational AI research and development that enhances personalized learning while protecting student privacy.
