The Freedom for Agricultural Repair and Maintenance Act, or FARM Act, aims to ensure that original equipment manufacturers (OEMs) make essential resources available to farm equipment owners and independent repair providers. This includes documentation, parts, software, firmware, and tools necessary for diagnosing, maintaining, upgrading, reprogramming, or repairing farm equipment, along with access to farm equipment data. These resources must be provided on fair and reasonable terms , which specify cost and usage conditions, prohibiting OEMs from imposing undue restrictions or additional burdens on repair activities. The Act further requires OEMs to provide resources for disabling or enabling security functions for repair and allows circumvention of technological protection measures for repair, maintenance, interoperability, and security research, overriding certain copyright law restrictions. It mandates that OEMs ensure parts can be replaced using commonly available tools or tools provided on fair terms, with civil penalties for discontinuing offerings. The Federal Trade Commission (FTC) is responsible for enforcing these requirements, treating violations as unfair or deceptive acts and imposing escalating daily civil penalties for certain infractions, while clarifying that the Act does not compel the disclosure of trade secrets beyond what is necessary for repair or permit modifications violating safety or emissions laws.
